However, as in any industry, there are times when a buyer may want a refund for purchased programs. In this article, we will look at the legal aspects of refunds for online courses in Russia and the conditions that can be applied in various situations: if the course has not yet started, is already in progress or has ended.
Legislation of the Russian Federation and refund of funds
The issue of refunds for educational services is regulated by several laws and regulations, including the Civil Code of the Russian Federation, the Federal Law “On the Protection of Consumer Rights,” as well as legislation on education. According to Article 32 of the Federal Law “On the Protection of Consumer Rights,” the “student” has the right to refuse services at any time before the execution of the contract and demand a refund of the amount paid for it if the quality of the materials is not satisfactory, the course was not completed for good reasons, or the person changed his mind. If the buyer believes that the terms of the signed offer violate his rights as a consumer, he also has the right to compensation for moral damages, lost profits and other damages, including legal services.
In theory, the conditions for return and the specifics of unilateral termination of the contract should be specified in the offer. But in reality this rarely happens, because… such documents are aimed at protecting the interests of an online school or blogger. Even if the organization/author acts in this matter within the framework of current legislation, it is aimed at maximizing the protection of its interests, and not the buyer.
