The US is reforming the current patent system

Last weekend in the United States, the America Invents Act bill was approved by the Senate and approved by the President, radically changing the existing patent system.

Over the past 50 years, this is the first time in America that the patent system has undergone such significant changes, deviating from accepted standards.

The growing number of patent litigation in the United States has long required a legal settlement.

The main change being made to the legislation is to replace the “first-to-invent” system with “first-to-file”. Currently, the United States Patent and Trademark Office (USPTO) grants a technology patent to the first-to-invent person. After the bill comes into force, patents will be issued to the person who first filled out the application for registration of technology (first-to-file).

Currently, the US Patent and Trademark Office has a large number of patent complaints under review, and the government agency’s budget does not allow it to quickly deal with them.

Under the new law, the Bureau gains the right to independently set fees, thereby regulating its own budget.

It is expected that changes to the current patent system will attract new inventors, as well as eliminate cases of dubious patents describing obvious or already invented technologies, and cases of mutual accusations of companies against each other, the purpose of which is only to obtain monetary compensation for the harm caused.
