Decree of the Government of the Russian Federation dated December 10, 2008 N 941 approved the new “Regulations on patent and other duties for carrying out legally significant actions related to a patent for an invention, utility model, industrial design, with state registration of a trademark and service mark, with state registration and granting of an exclusive right to the name of the place of origin of a product, as well as with state registration of the transfer of exclusive rights to other persons and agreements on the disposal of these rights.” The provision takes into account changes associated with the entry into force of Part 4 of the Civil Code of the Russian Federation.
According to the new Regulations, duties are established and paid only in rubles, without reference to foreign currencies. The duties established for trademarks and appellations of origin of goods, as before, are charged on a single scale. On average, duties on this scale increased by 20 percent. Fees established for patenting inventions, utility models and industrial designs are levied on a double scale – separately for residents and non-residents. At the same time, the fees for residents are approximately 4 times lower than the fees for non-residents. The regulation came into force on January 7, 2009.
