In 2021, a collection of articles “Art law review” about legal regulation in the field of art was published from the world-famous publishing house Law Business Research. The articles in the collection are divided into two topics: current legal issues of the global art industry and a detailed overview of the legislation of various countries within this area. With their works, the authors put an unequivocal point in the discussion about the need to separate legal regulation in the art industry from civil legislation. “Art law review” is a unique study in its scope from specialists from the world’s leading law firms; it covers more than 20 countries. The review of Russian legislation was prepared by a team of the international bar association “Levant and Partners” under the leadership of Matvey Levant with the assistance of external specialists.
Despite the fact that the turnover of the global art market decreased in 2020, we can definitely say that the Russian art market is still developing and showed growth in 2019. However, the number of litigation related to this industry is extremely low. The high demand for Russian art in the West and the relatively small supply encourage the state to exercise closer control over this area and introduce new mechanisms aimed at preserving and protecting artistic and cultural values in legal, administrative and organizational aspects. In a broad sense, it is noted that there is no specially developed regulation; thus, commercial relations with works of art are subject to the general requirements of civil law for objects of civil rights with some restrictions in relation to objects of cultural heritage established by the Constitution of the Russian Federation and the Civil Code of the Russian Federation.
