By Decree of President Dmitry Medvedev of May 24, 2011 No. 673, the Federal Service for Intellectual Property was created. The decree is aimed at creating a holistic and effective mechanism for managing the rights of the Russian Federation to the results of intellectual activity and their protection through a clear distribution of functions of federal executive authorities. In addition to the functions of Rospatent, it will receive the powers of the Federal Agency for Legal Protection of the Results of Intellectual Activity (FAPRID), which protects the interests of the state in the circulation of the results of intellectual activity of military, special and dual-use. Until now, Rospatent, under the jurisdiction of the Ministry of Education and Science, controlled the results of intellectual activity related to economic and civil fields. FAPRID, subordinate to the Ministry of Justice, was engaged in the legal protection of state interests in the sphere of circulation of the results of intellectual activity of military, special and dual-use. Thus, we are talking about two reforms at once – assigning responsibilities to Rospatent to ensure that government customers formalize the results of R&D, and about unifying the “civil” and “military” spheres in the protection of intellectual property.
